Additional Information For Alberta Public Inquiries and Inspections
The information listed below, was compiled and provided by a research contact. A clear history of procedural fairness is evident in this historical information.
Somewhere ex-post the 1994 Municipal Government Act amendments which introduced “natural person powers” for municipalities, the province went wild with Fly-By-Night contract inspectors. The only report to provide procedural fairness since 1994 is (“The Clark Report”) from June 22, 2005. (Item [10] on this page.) For some bizarre reason what appears to be a reasonable level of procedural fairness, is provided to those individuals with standing during the Clark Inspection. The same level of fairness does not exist in other inspection reports beyond 1994 and to the present time.
Big questions arise in the average mind, as to why such a high level of fairness was granted to the City of Calgary Ward 10 Election Inspection, In comparison, the same level of fairness was denied in numerous municipalities where Fly-by-Night inspectors ran wild with bullying tactics and the publishing of defamatory reports without opportunity to he heard.
As you review this historical information you will notice a solid structure to the procedures of inspections and inquiries by way of specific terms of reference, according to municipal and inquiry statutes, and common law. Now in this modern era, the new history reveals that Alberta uses two conflicting inspection procedures, while conducting identical section 571 inspections.
